Insurance underwriting is fundamentally about answering three questions:

- Can the insured demonstrate reasonable controls? (Loss mitigation)
- What can go wrong? The output space of a generative agent is unbounded. It can say or do things the developer never anticipated.
- How likely is it? Without deployment-time monitoring, there’s no historical data on agent behavior in production. No actuarial table for AI incidents.
- Can the insured demonstrate controls? Most organizations can show their model was trained safely. Almost none can show it’s deployed safely — with bounded execution, audit trails, escalation logic, and kill switches.

- Audit your AI agent inventory. How many autonomous agents are running? What authority do they have? What decisions can they make without human approval?
- Call your insurance broker. Ask specifically whether your cyber policy covers incidents caused by autonomous AI systems. Get the answer in writing.
- Assess your audit trail. Can you replay any agent decision from the last 30 days? Can you prove what the agent knew and what authority it was operating under?
- Evaluate your escalation logic. When your agent is uncertain, what happens? Does it guess? Does it fail? Does it escalate to a human with full context?
- Close the gap. Deploy runtime governance that gives you bounded execution, tamper-evident records, operator escalation, and adaptive recovery.
For traditional software, these questions have clear answers. Code is deterministic. You can audit it. You can test it. You can prove what it does and doesn’t do.
For autonomous AI agents, underwriters can’t get satisfactory answers to any of the three:

The exclusion isn’t permanent. It’s conditional. Insurers will cover autonomous AI when organizations can demonstrate three things:
1. Verifiable Decision Records
Every agent action is logged in a structured audit trail with integrity verification that can be replayed and audited. Not a text log that can be silently edited — a hash-chained record that shows what the agent knew, what authority it operated under, and what decision it made.
This gives underwriters the historical data they need to price risk. It gives your legal team the evidence they need in litigation. And it gives regulators the transparency they’re increasingly demanding.
2. Enforced Operational Boundaries
The agent operates within defined authority envelopes that are enforced at runtime — not suggested by training. If the agent attempts an action outside its boundaries, it’s blocked before execution.
This is the difference between "we trained it not to do that" (hope) and "the runtime prevents it from doing that" (control). Insurers underwrite control, not hope.
3. Documented Escalation Paths
When the agent encounters a decision above its authority level or below its confidence threshold, it escalates to a human operator. The escalation is logged, the human decision is recorded, and the chain of custody is maintained.
This preserves the human-in-the-loop that insurers and regulators require without the overhead of humans reviewing every routine action.
